A) The Commissioner shall prescribe by rule a schedule of controlled substance metabolites and parent drug substances which are capable of providing the same clinical measure of a specific controlled substance as the controlled substance. An employee shall not have to be given a written test by the laboratory before providing drug metabolites or parent drug testing. (b) The substances listed under this subdivision shall be dispensed by a laboratory which is authorized to process controlled substance samples under this chapter. Laboratory authorization may be provided by the Commissioner by regulation. (3) (a) Upon request of the lab, an employee shall present a specimen for analysis in a manner that produces a reasonable degree of specificity. A laboratory has the right to request additional lab specimens based on laboratory findings. This guidance includes revised and expanded language on the standard format for drug test results. This revision represents the standard of care for all facilities and agencies seeking to determine the result of a drug test. The updated CCF Form defines the minimum standards that will be used, when the evidence is provided, to determine what happened at the facility. There is no current policy or position regarding the testing of prisoners. The US Department of Justice and the White House Office of National Drug Control Policy (ONDCP) have yet to issue guidelines, either in writing or verbal, with which to evaluate the potential of drug testing of prisoners.
